SOCIAL SECURITY ACT 1991 No. 46, 1991 - SECT 113

Inmates of benevolent homes
113. (1) While a person who is receiving an invalid pension is an inmate of a
benevolent home:

   (a)  so much of the person's pension as does not exceed the pensioner
        contribution is to be paid to the person who controls the
        benevolent home for the maintenance of the person in the
        benevolent home; and

   (b)  the balance (if any) is to be paid to the person receiving the
        pension.

(2) For the purposes of this section, the pensioner contribution is, subject
to subsection (3), 364 times the amount in force from time to time for the
purposes of subparagraph 47 (2) (b) (iii) of the National Health Act 1953.

(3) If the amount worked out under subsection (2) is not a multiple of $2.60,
the pensioner contribution is the next lower amount that is a multiple of
$2.60.
