SYDNEY HARBOUR FEDERATION TRUST ACT 2001 No. 2, 2001 - SECT 38B

Transitional—leases and licences granted before plans take effect
(1)
This section applies to leases and licences granted under section 38A before a plan takes effect for an area.

(2)
A lease or licence for a fixed term over an area of Trust land:

(a)
must not be for a term of more than 12 months; and

(b)
must expire within 18 months after the vesting of the land in the Trust.

(3)
A period under a lease for a periodic tenancy:

(a)
must not extend for more than one month; and

(b)
must not begin after a plan takes effect for any of the area over which the lease is granted.

(4)
A licence that is not for a fixed term must be revoked before a plan takes effect for any of the area over which the licence is granted.

(5)
If a lease or fixed-term licence is in force for an area when a plan takes effect, then the plan takes effect except to the extent that it interferes with the operation of the lease or licence in that area.

(6)
A lease or licence that contravenes this section or subsection 38A(2) or
(3)
is void.
