Payments made before Royal Assent SCHEDULE 1 SCHEDULE 2 STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - LONG TITLE An Act to amend the States Grants (Tertiary Education Assistance) Act 1984, and for related purposes STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 1 Short title etc. (Assented to 16 December 1987) 1. (1) This Act may be cited as the States Grants (Tertiary Education Assistance) Amendment Act (No. 2) 1987. (2) In this Act, "Principal Act" means the States Grants (Tertiary Education Assistance) Act 1984*1*. (Minister's second reading speech made in- House of Representatives on 5 November 1987 Senate on 19 November 1987) *1* No. 127, 1984, as amended. For previous amendments, see Nos. 61, 160 and 165, 1985; Nos. 67, 134 and 165, 1986; and No. 36, 1987. STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 2 Commencement 2. This Act shall come into operation on the day on which it receives the Royal Assent. STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 3 Interpretation 3. Section 3 of the Principal Act is amended by adding at the end the following subsections: "(12) A reference in this Act to the Minister exercising a power on the recommendation of the Commission or after obtaining the advice of the Commission shall be read, on and after the commencement of this section, as a reference to the Minister exercising the power whether on the recommendation of the Commission or otherwise and whether or not the Minister has obtained the advice of the Commission. "(13) A reference in a provision set out in Schedule 24 to this Act to the Commission shall be read, on and after the commencement of this section, as a reference to the Minister.". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 4 New teaching developments 4. Section 4 of the Principal Act is amended: (a) by omitting from subsections (1) and (2) "recommend to the Minister that the Minister"; and (b) by omitting from subsection (6) "to the Minister and". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 5 Promotion of equality of opportunity 5. Section 7 of the Principal Act is amended by omitting from paragraph (5) (c) "$1,209,000" and substituting "$1,191,500". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 6 Special assistance for students 6. Section 9 of the Principal Act is amended by omitting from subsection (2) "$11,196,500" and substituting "$11,195,500". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 7 Key centres of teaching and research 7. Section 10 of the Principal Act is amended by omitting from paragraph (4) (c) "$1,209,000" and substituting "$1,211,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 8 Recurrent grants may be increased to assist institutions in meeting certain superannuation expenses 8. Section 11 of the Principal Act is amended by omitting from paragraph (3) (c) "$29,564,000" and substituting "$29,608,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 9 Special research centres 9. Section 14 of the Principal Act is amended by omitting from paragraph (4) (c) "$5,700,000" and substituting "$5,719,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 10 Traineeship grants 10. Section 23A of the Principal Act is amended by omitting from subsection (6) "$4,000,000" and substituting "$3,720,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 11 Delegation 11. Section 48 of the Principal Act is amended by inserting in subsection (1) "or to an officer of the Department" after "of the Commission". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 12 Substitution of Schedules 12. Schedules 1, 2, 3, 4, 5, 6, 6A, 7, 8, 9, 10, 11, 12, 13 and 23 to the Principal Act are repealed and the Schedules set out in Schedule 1 to this Act are substituted. STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 13 Insertion of new Schedule 24 13. After Schedule 23 to the Principal Act the Schedule set out in Schedule 2 to this Act is inserted. STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT (No. 2) 1987 No. 124, 1987 - SECT 14 Payments made before Royal Assent 14. Payments (including advances) by way of financial assistance made to a State or to the Northern Territory under the Principal Act shall be deemed to have been made also for the purposes of the Principal Act as amended by this Act.
