(Assented to 4 June 1985) 1. (1) This Act may be cited as the States Grants (Tertiary Education Assistance) Amendment Act 1985. (2) The States Grants (Tertiary Education Assistance) Act 1984 *1* is in this Act referred to as the Principal Act. *1* No. 127, 1984. (Minister's second reading speech made in- House of Representatives on 9 May 1985; Senate on 20 May 1985) STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 2 Commencement 2. This Act shall come into operation on the day on which it receives the Royal Assent. STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 3 Promotion of equality of opportunity 3. Section 7 of the Principal Act is amended- (a) by omitting from paragraph (5) (a) "$1,049,000" and substituting "$1,079,000"; (b) by omitting from paragraph (5) (b) "$1,049,000" and substituting "$1,093,000"; and (c) by omitting from paragraph (5) (c) "$1,049,000" and substituting "$1,093,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 4 Recurrent grants may be increased to assist institutions in promoting greater participation of Aboriginals in tertiary education 4. Section 8 of the Principal Act is amended- (a) by omitting from paragraph (3) (a) "$839,000" and substituting "$805,000"; (b) by omitting from paragraph (3) (b) "$1,574,000" and substituting "$1,640,000"; and (c) by omitting from paragraph (3) (c) "$2,098,000" and substituting "$2,186,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 5 Special assistance for students 5. Section 9 of the Principal Act is amended by omitting sub-section (2) and substituting the following sub-section: "(2) The aggregate of all of the amounts payable under sub-section (1) in respect of the triennium consisting of the years 1985, 1986 and 1987 shall not exceed $10,756,000.". Section 10 of the Principal Act is amended- (a) by omitting from paragraph (4) (a) "$1,049,000" and substituting "$1,079,000"; (b) by omitting from paragraph (4) (b) "$1,049,000" and substituting "$1,093,000"; and (c) by omitting from paragraph (4) (c) "$1,049,000" and substituting "$1,093,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 7 Recurrent grants may be increased to assist institutions in meeting certain superannuation expenses 7. Section 11 of the Principal Act is amended- (a) by omitting from paragraph (3) (a) "$15,945,000" and substituting "$16,401,000"; (b) by omitting from paragraph (3) (b) "$20,141,000" and substituting "$20,986,000"; and (c) by omitting from paragraph (3) (c) "$23,288,000" and substituting "$24,265,000". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 8 Recurrent grants in respect of student residences and affiliated colleges 8. Section 12 of the Principal Act is amended- (a) by omitting from paragraph (2) (a) "$2,435,000" and substituting "$2,504,000"; (b) by omitting from paragraph (2) (b) "$1,266,000" and substituting "$1,318,000"; (c) by omitting from paragraph (3) (a) "$749,000" and substituting "$771,000"; and (d) by omitting from paragraph (3) (b) "$374,000" and substituting "$391,000". Section 14 of the Principal Act is amended- (a) by omitting from paragraph (4) (a) "$4,957,000" and substituting "$5,104,000"; (b) by omitting from paragraph (4) (b) "$4,957,000" and substituting "$5,161,000"; and (c) by omitting from paragraph (4) (c) "$4,957,000" and substituting "$5,161,000". Section 31 of the Principal Act is amended- (a) by omitting from sub-section (3) "sub-sections" and substituting "sub-section"; and (b) by omitting from sub-section (3) "a reference" and substituting "references". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 11 Variations affecting State entitlements to grants 11. Section 36 of the Principal Act is amended- (a) by inserting in sub-section (3) "and (b)" after "(1) (a)"; (b) by omitting from sub-section (3) "sub-sections" and substituting "sub-section"; and (c) by omitting from sub-section (3) "a reference" and substituting "references". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 12 Variation of certain Schedules relating to building projects 12. Section 41 of the Principal Act is amended by inserting after sub-section (3) the following sub-sections: "(3A) Subject to sub-section 42 (1), the Minister may, from time to time, after obtaining the advice of the Commission, direct that this Act has effect as if all or any of the amounts specified in Column 3 of Schedule 18, 19 or 20 were varied in accordance with the direction, and, where the Minister gives a direction with respect to the variation of any such amounts, then, for the purposes of this Act (including this section), there shall be deemed to have been specified (as from the day on which this Act came into operation) in that Schedule or those Schedules, as the case requires, in substitution for those amounts, those amounts as so varied. "(3B) The Minister may, from time to time, after obtaining the advice of the Commission, direct that this Act has effect as if a description of a project specified in Column 2 of Schedule 18, 19 or 20 were varied in accordance with the direction, and, where the Minister gives a direction with respect to the variation of any such description, then, for the purposes of this Act (including this section), there shall be deemed to have been specified (as from the day on which this Act came into operation) in that Schedule, in substitution for that description, that description as so varied.". Section 42 of the Principal Act is amended- (a) by omitting from sub-section (1) "sub-section 41 (1) or (2)" and substituting "sub-section 41 (1), (2) or (3A)"; (b) by omitting from sub-section (3) "sub-sections" and substituting "sub-section"; and (c) by omitting from sub-section (3) "a reference" and substituting "references". Section 46 of the Principal Act is amended by omitting from sub-section (5) "a reference" and substituting "references". STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 15 Repeal of Schedules and substitution of new Schedules 15. Schedules 1 to 23 (inclusive) to the Principal Act are repealed and the Schedules set out in Schedule 1 to this Act are substituted. STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) AMENDMENT ACT 1985 No. 61, 1985 - SECT 16 Payments made before Royal Assent 16. Payments (including advances) by way of financial assistance made to a State or to the Northern Territory under the Principal Act shall be deemed to have been made for the purposes of the Principal
