STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) ACT 1981 No. 167, 1981 - SECT 39

39. (1) Where the Minister is satisfied that a university specified in Column
1 of Part II of Schedule 17 is not undertaking, or will not be undertaking,
during the year 1982, teaching responsibilities of a kind that were
undertaken, during the year 1981, by the college of advanced education the
name of which is set out in Column 2 of that Part opposite to the name of that
university, the Minister may direct that this Act shall have effect as if the
amount specified in Column 2 of Schedule 1 in relation to that university were
reduced by such amount as he determines, after having regard to the advice of
the Commission, to be appropriate and the amount specified in Part V of
Schedule 8 were increased by a corresponding amount and, where he does so,
there shall be deemed to have been specified in Column 2 of Schedule 1 and in
Part V of Schedule 8 (as from the commencing day), in substitution for the
amount specified in that Column and in Part V of Schedule 8, those amounts as
so varied.

(2) A direction given under sub-section (1) to the effect that this Act shall
have effect as if the amount specified in Column 2 of Schedule 1 in relation
to a university were reduced by an amount (in this sub-section
referred to as the ''first amount'') determined by the Minister shall also
provide that this Act shall have effect as if the amount specified in relation
to that university in Column 3 of Schedule 2A were reduced by such amount (in
this sub-section referred to as the ''second amount'') as the Minister
determines, after having regard to the advice of the Commission, to be
appropriate, being an amount that does not exceed the first amount and, upon
that direction's having been given, there shall be deemed to have been
specified in Column 3 of Schedule 2A (as from the commencing day) in
substitution for the amount specified in that Column the amount (if any) by
which the amount so specified exceeds the second amount.

(3) As soon as practicable after the Minister has given a direction under
sub-section (1), he shall cause a statement setting out particulars of the
direction to be laid before each House of the Parliament.
