(1) This section applies to each non-systemic school (other than a special school):

(a)

that is included in the list of non-government schools because of subsection 122(1); and

(b)

that was covered by an application for a new school proposal (within the meaning of the former Act):

(i)

that was made after 11 May 1999 under that Act; and

(ii)

in relation to which the Minister varied the list (within the meaning of that Act) with effect from a day in the 1999 or 2000 program year (within the meaning of that Act); and

(c)

for which the Minister has determined an SES score.

(2) The Minister must vary the list to set out the SES funding level for the school's SES score as the funding level of the school. (3) A variation under this section takes effect on 1 January 2001.
