(1) This section is a simplified outline of this Part. (2) Financial assistance to a State for government schools must not be paid unless there is an agreement between the Commonwealth and the State. (3) The agreement must set out the conditions on financial assistance required by Division 2. The agreement may also set out other conditions. (4) If there is a breach of a condition, the Minister may require an amount to be repaid to the Commonwealth. Alternatively, the Minister may reduce or delay the amount of other payments under this Act. (5) Financial assistance to a State for a non-government school or system must not be paid unless there is an agreement between the Commonwealth and the relevant authority of the school or system that sets out the requirements mentioned in Division 3. The agreement may also set out other requirements. (6) If there is a breach of a requirement, the Minister may require an amount to be repaid to the Commonwealth. Alternatively, the Minister may reduce or delay the amount of other payments for the non-government school under this Act. (7) The grant to a State of financial assistance for a non-government school for a program year is subject to conditions.
