STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139 of 1974 An Act to amend the States Grants (Universities) Act 1972-1973, as amended by the States Grants (Universities) Act 1974. BE IT ENACTED by the Queen, the Senate and the House of Representatives of Australia, as follows:- Short title and citation. 1. (1) This Act may be cited as the States Grants (Universitites) Act (No. 2) 1974.* (2) The States Grants (Universities) Act 1972-1973,* as amended by the States Grants (Universities) Act 1974,* is in this Act referred to as the Principal Act. (3) Section 1 of the States Grants (Universities) Act 1974 is amended by omitting sub-section (3). (4) The Principal Act, as amended by this Act, may be cited as the States Grants (Universities) Act 1972-1974. STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 2 Commencement. 2. This Act shall come into operation on the day on which it receives the Royal Assent.* STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 3 Salary rates. 3. Section 4 of the Principal Act is amended- (a) by omitting sub-section (1) and substituting the following sub-section:- "(1) For the purposes of financial assistance under this Act- (a) the approved rate of basic professorial remuneration is $19,614 per annum; (b) the approved rate of remuneration for an associate professor or a reader is $16,389 per annum; (c) the approved maximum rate of remuneration for a senior lecturer is $14,724 per annum; (d) the approved minimum rate of remuneration for a senior lecturer is $12,643 per annum; (e) the approved maximum rate of remuneration for a lecturer is $12,352 per annum; (f) the approved minimum rate of remuneration for a lecturer is $9,002 per annum; (g) the approved maximum rate of remuneration for a principal tutor is $11,396 per annum; (h) the approved minimum rate of remuneration for a principal tutor is $9,002 per annum; (i) the approved maximum rate of remuneration for a senior tutor or senior demonstrator is $9,002 per annum; (j) the approved minimum rate of remuneration for a senior tutor or a senior demonstrator is $7,545 per annum; (k) the approved maximum rate of remuneration for a tutor or demonstrator is $7,285 per annum; and (l) the approved minimum rate of remuneration for a tutor or demonstrator is $5,985 per annum."; (b) by omitting from sub-section (2) the words ", in a year to which this Act applies, has paid" and substituting the words "has, after the date of commencement of the States Grants (Universities) Act (No. 2) 1974, paid"; and (c) by omitting from sub-section (2) all the words after the words "to that University" and substituting the words "in respect of the year to which this Act applies in which that remuneration was paid shall be reduced by such amount as he considers reasonable having regard to the fact that the approved rates referred to in that sub-section have not been observed.". STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 4 4. After section 5 of the Principal Act the following section is inserted:- Additional grants for cost increases. "5A. (1) Subject to this section, where- (a) a University is specified in the Twelfth Schedule; and (b) the cost of a project of that University that is specified in relation to that University in the second column of the Second Schedule, exceeds, or appears to the Minister likely to exceed, the sum of the amount specified opposite to that project in the third column of that Schedule and one-fifth of that amount, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to that project, in addition to the amount payable in respect of the project under section 5, such amount as the Minister determines, not exceeding the amount of the excess or the likely excess. "(2) Amounts determined by the Minister under sub-section (1) in respect of projects of a University shall not, in the aggregate, exceed the amount specified in relation to that University in the Twelfth Schedule. "(3) The financial assistance to a State by way of payment of an amount under sub-section (1) in relation to a project of a University is granted on the condition that- (a) the State will, without undue delay, pay the amount to the University; and (b) the State will ensure that the amount so paid to the University is applied by the University, without undue delay, towards the carrying out of that project.". STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 5 5. After section 8 of the Principal Act the following section is inserted:- Additional grants for cost increases. "8A. (1) For the purposes of this section, a reference to a project of a hall of residence or residential college is a reference to a project of the kind referred to in sub-section (1) of section 8. "(2) Subject to this section, where- (a) a University is specified in the Thirteenth Schedule; and (b) it appears to the Minister that, by reason of increases in the cost of projects of halls of residence or residential colleges of that university, being projects for the provision of accommodation of a kind in respect of which an amount is specified in relation to that University in a particular column of the Fifth Schedule, the amount that may be paid under section 8 in respect of those projects should be supplemented, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to those projects, in addition to the amount payable in respect of those projects under section 8, such amount as the Minister determines. "(3) Subject to sub-section (4), amounts determined by the Minister under sub-section (2) in respect of projects of the halls of residence and residential colleges of a University shall not, in the aggregate, exceed the amount specified in relation to that University in the Thirteenth Schedule. "(4) If, at any time during the period of 3 years to which this Act applies, the Minister is satisfied that the whole of the amount specified in the Thirteenth Schedule in relation to a University will not be required for the purpose of grants under sub-section (2) in relation to projects of the halls of residence and residential colleges of that University, he may determine that this section shall have effect as if- (a) an amount specified in his determination were deducted from the amount specified in the Thirteenth Schedule in relation to that University; and (b) an amount equal to, or amounts specified by the Minister in his determination that are together equal to, the amount so deducted, were added to the amount or amounts specified in that Schedule in relation to another University or other Universities, as the case may be. "(5) The financial assistance to a State by way of payment of an amount under sub-section (2) is granted on the condition that the State will, without undue delay, pay that amount to the University or to the bodies administering the halls of residence or residential colleges.". STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 6 Recurrent grants in respect of halls of residence and residential colleges. 6. Section 9 of the Principal Act is amended by omitting sub-sections (2), (3) and (4) and substituting the following sub-sections:- "(2) In relation to each hall of residence, there is payable to a State under this section, in respect of each of the years 1974 and 1975, $5,510. "(3) In relation to each residential college, there is payable to a State under this section, in respect of each of the years 1974 and 1975, the amount that is specified in the following table in relation to the number of resident full-time students of the college in that year:- -------------------------------------------------------------------------------- Number of resident full-time students Amount -------------------------------------------------------------------------------- $ Less than 100 . . . . . . . . . . . . . . . . . . . . . . . . . . . 5,510 Not less than 100 but less than 120 . . . . . . . . . . . . . . . . 6,060 Not less than 120 but less than 140 . . . . . . . . . . . . . . . . 6,610 Not less than 140 but less than 160 . . . . . . . . . . . . . . . . 7,160 Not less than 160 but less than 180 . . . . . . . . . . . . . . . . 7,720 Not less than 180 . . . . . . . . . . . . . . . . . . . . . . . . . 8,270 -------------------------------------------------------------------------------- "(4) In addition to the amount payable in accordance with sub- section (2) or sub-section (3) there is payable under this section, in respect of each of the years 1974 and 1975, in relation to each hall of residence or residential college, the sum of- (a) an amount calculated by multiplying $66.10 by the number of resident full-time undergraduate students of the hall of residence or residential college in that year; (b) an amount calculated by multiplying $33.10 by the number of resident full-time post-graduate students of the hall of residence or residential college in that year; and (c) an amount calculated by multiplying $11 by the number of non-resident students of the hall of residence or residential college in that year.". STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 7 7. After section 10 of the Principal Act the following section is inserted:- Additional grants for cost increases. "10A. (1) Subject to this section, where- (a) a University is specified in the Fourteenth Schedule; and (b) the cost of a teaching hospital project of that University that is specified in relation to that University in the second column of the Sixth Schedule, exceeds, or appears to the Minister likely to exceed, the sum of the amount specified opposite to that project in the third column of that Schedule and one-fifth of that amount, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to that project, in addition to the amount payable in respect of that project under section 10, such amount as the Minister determines, not exceeding the amount of the excess or the likely excess. "(2) Amounts determined by the Minister under sub-section (1) in respect of the teaching hospital projects of a University shall not, in the aggregate, exceed the amount specified in relation to that University in the Fourteenth Schedule. "(3) The financial assistance to a State by way of payment of an amount under sub-section (1) in relation to a project of a University is granted on the condition that- (a) the State will, without undue delay, pay the amount to the University; and (b) the State will ensure that the amount so paid to the University is applied by the University, without undue delay, towards the carrying out of that project.". STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 8 8. After section 15 of the Principal Act the following section is inserted:- Delegation by the Commission. "15A. (1) The Commission may, by resolution, either generally or otherwise as provided in the resolution, delegate to the Chairman or a Deputy Chairman of the Commission all or any of its powers under this Act, except this power of delegation. "(2) A power so delegated may be exercised by the delegate in accordance with the resolution delegating that power. "(3) A delegation under this section is revocable by resolution of the Commission and does not prevent the exercise of a power by the Commission.". STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 9 Parts II and III of the First Schedule. 9. The First Schedule to the Principal Act is amended by omitting Parts II and III and substituting the Parts set out in Schedule 1 to this Act. STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 10 Fourth Schedule. 10. The Fourth Schedule to the Principal Act is repealed and the Schedule set out in Schedule 2 to this Act substituted. STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 11 Parts II and III of the Seventh Schedule. 11. The Seventh Schedule to the Principal Act is amended by omitting Parts II and III and substituting the Parts set out in Schedule 3 to this Act. STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 12 Tenth and Eleventh Schedules. 12. The Tenth and Eleventh Schedules to the Principal Act are repealed and the Schedules set out in Schedule 4 to this Act substituted. STATES GRANTS (UNIVERSITIES) ACT (No. 2) 1974 No. 139, 1974 - SECT 13 Twelfth, Thirteenth and Fourteenth Schedules. 13.
