STUDENT ASSISTANCE (YOUTH TRAINING ALLOWANCE) AMENDMENT ACT 1994 No. 183, 1994 - SECT 39
Transitional provision-review of student assistance benefit decision not yet heard by SART
39.(1) If, before 1 January 1995, a request to the Secretary to the Department
of Employment, Education and Training for the review of a decision of a senior
authorised person or a senior prescribed officer:
(a) had not been referred to a Convenor of the Student Assistance Review
Tribunal ("SART"); or
(b) had been referred to a Convenor of the SART but the Convenor:
(i) had not arranged for a panel of the SART to undertake the
review; or
(ii) had so arranged but the review had not commenced; that request
is to be treated, on and after that day, for all purposes, as
if
it were an application to the Social Security Appeals Tribunal ("SSAT") and is
to be forwarded by the Secretary, on, or as soon as practicable after, that
day, to the National Convener of the SSAT.
(2) If an application is forwarded by the Secretary in accordance with
subsection (1) to the National Convener of the SSAT, the Secretary is taken to
have complied with subsection 1261(1) of the Social Security Act 1991.
