ROAD TRANSPORT REFORM (DANGEROUS GOODS) ACT 1995 No. 34, 1995 - SECT 49
Assistance in emergencies or accidents
49.(1) A person does not incur civil liability for an act done honestly and in
good faith, and without any fee, charge or other reward, for the purpose of
assisting or attempting to assist in a situation in which an emergency or
accident involving dangerous goods occurs or is likely to occur.
(2) Subsection (1) does not apply to a person whose act or omission was wholly
or partly the cause of the occurrence or likely occurrence.
(3) Subsection (1) applies to a government authority even though the authority
requires payment for a service provided in connection with the occurrence or
likely occurrence.
(4) This section does not apply to an authorised officer.
