RACIAL DISCRIMINATION ACT 1975 No. 52, 1975 - SECT 9

Racial discrimination to be unlawful.
9. (1) It is unlawful for a person to do any act involving a distinction,
exclusion, restriction or preference based on race, colour, descent or
national or ethnic origin which has the purpose or effect of nullifying or
impairing the recognition, enjoyment or exercise, on an equal footing, of any
human right or fundamental freedom in the political, economic, social,
cultural or any other field of public life.

(2) The reference in sub-section (1) to a human right or fundamental freedom
in the political, economic, social, cultural or any other field of public life
includes a reference to any right of a kind referred to in Article 5 of the
Convention.

(3) Sub-section (1) does not apply in respect of the employment, or an
application for the employment, of a person on a ship or aircraft (not being
an Australian ship or aircraft) if that person was engaged, or applied, for
that employment outside Australia.

(4) The succeeding provisions of this Part do not limit the generality of
sub-section (1).
