PASTURE SEED LEVY ACT 1989 No. 146, 1989 - SECT 9

9. (1) The Minister may, by instrument published in the Gazette, declare that
the Schedule is to be taken to be amended in a manner specified in the
instrument, and that declaration has effect accordingly.

(2) Before making an instrument under subsection (1), the Minister shall take
into consideration any relevant recommendation made to him or her by the
growers organisation.

(3) The Schedule is not to be varied so that it sets out a rate of levy higher
than $50.00 per tonne.

(4) The instrument is a disallowable instrument for the purposes of section
46A of the Acts Interpretation Act 1901.

(5) For the purposes of section 8 of the Acts Interpretation Act 1901, a
declaration under subsection (1) that is taken to amend the Schedule by way of
repealing part of it is to be taken to be an Act that repeals that part.
