OFFSHORE MINERALS ACT 1994 No. 28, 1994 - SECT 28

28. For the purposes of this Act, a core, cutting or sample is a
confidential sample if:

   (a)  a licence holder has given it to the Designated Authority; and

   (b)  it was recovered in the course of activities authorised by the
        licence; and

   (c)  it was recovered from an area of the seabed or subsoil of an offshore
        area that is covered by the licence or a successor licence to the
        licence.
