OCCUPATIONAL HEALTH AND SAFETY (MARITIME INDUSTRY) ACT 1993 No. 10, 1994 - SECT 120

Regulations-general
120. (1) Without limiting the generality of the power to make regulations for
the purposes of this Act, the regulations may prescribe:

   (a)  procedures for the election of persons, under sections 41, 42, 43 and
        44, as health and safety representatives; and

   (b)  procedures for the selection of persons, under section 73, as members
        of health and safety committees, to represent the interests of
        employees; and

   (c)  procedures to be followed at meetings of health and safety committees;
        and

   (d)  the manner in which notices are to be served under this Act or the
        regulations; and

   (e)  forms for the purposes of this Act or the regulations.

(2) If the Governor-General is satisfied that:

   (a)  a power, function or duty is conferred or imposed on a person under a
        law of the Commonwealth or of a State or Territory; and

   (b)  the proper exercise of the power or performance of the function or
        duty is or would be prevented by this Act or a provision of this Act;
        regulations made for the purposes of this subsection may declare that
        this Act, or the provision, as the case may be, does not apply to that
        person, or does not apply to that person in the circumstances
        specified in the regulations.

(3) Regulations made for the purposes of subsection (2) do not remain in force
for longer than 5 years after they commence, but this subsection does not
prevent the making of further regulations of the same substance.
(4) In subsection (2), "this Act" includes regulations made for the purposes
of this Act.
