OCCUPATIONAL HEALTH AND SAFETY (MARITIME INDUSTRY) ACT 1993 No. 10, 1994 - SECT 12

Consultative processes for developing health and safety policy
12. (1) An operator of a prescribed ship or prescribed unit must take all
reasonable steps to develop a policy relating to the occupational health and
safety of employees in accordance with this section. Penalty: 1,000 penalty
units.

(2) The policy must be developed in consultation with any involved unions in
relation to the employees, and with such other persons as the operator
considers appropriate.

(3) The policy must:

   (a)  enable the operator and the employees to cooperate effectively in
        promoting and developing measures to ensure the employees' health,
        safety and welfare at work; and

   (b)  provide adequate mechanisms for reviewing the effectiveness of the
        measures.

(4) The policy must:

   (a)  provide appropriate mechanisms for continuing consultations between
        the operator, the involved unions and the employees on occupational
        health and safety matters; and

   (b)  provide for such other matters (if any) as are agreed between the
        operator and the involved unions.
