OCCUPATIONAL HEALTH AND SAFETY (COMMONWEALTH EMPLOYMENT) ACT 1991 No. 30, 1991 - SECT 11

11. (1) This Act binds the Crown in right of the Commonwealth.

(2) Nothing in this Act renders:

   (a)  the Commonwealth; or

   (b)  a Commonwealth authority other than a Government business enterprise;
        or

   (c)  a person who is employed by:

        (i)    the Commonwealth; or

        (ii)   a Commonwealth authority other than a Government
               business enterprise; liable to be prosecuted for an offence.

(3) Subsection (2) does not prevent the prosecution of:

   (a)  a Government business enterprise; or

   (b)  a person employed by a Government business enterprise.
