NATIVE TITLE ACT 1993 No. 110, 1993 - SECT 21
Agreements to surrender etc. native title Extent of agreements
21.(1) Native title holders may, under an agreement with the Commonwealth, a
State or a Territory:
(a) by surrendering their native title rights and interests in relation to
land or waters of the Commonwealth, the State or the Territory (as the
case may be), extinguish those rights and interests; or
(b) authorise any future act that will affect their native title.
Agreement to consideration or conditions
(2) The agreement may be given for any consideration, and subject to any
conditions, agreed by the parties (other than consideration or conditions that
contravene any law). Consideration may be freehold grant or other accepted
interests
(3) Without limiting subsection (2), the consideration may be the grant of a
freehold estate in any land or any other interests in relation to land,
whether statutory or otherwise, that the native title holders may choose to
accept. Regional or local agreements
(4) Subsection (1) does not prevent agreements mentioned in that subsection
being made by native title holders on a regional or local basis.
