NATIONAL OCCUPATIONAL HEALTH AND SAFETY COMMISSION ACT 1985 No. 35, 1985 - SECT 19

Meetings of Commission
19. (1) Subject to this section, meetings of the Commission shall be held at
such times and places as the Commission from time to time determines.

(2) The Chairperson -

   (a)  may convene a meeting of the Commission; and

   (b)  shall convene a meeting of the Commission on receipt of a written
request signed by not less than 9 members.

(3) The Commission shall hold not less than 3 meetings each calendar year.

(4) At a meeting of the Commission, 12 members constitute a quorum if, of the
members present at the meeting -

   (a)  at least one is a member referred to in paragraph 10 (1) (b) or the
alternate of such a member;

   (b)  at least one is a member referred to in paragraph 10 (1) (c) or the
alternate of such a member; and

   (c)  at least one is the member referred to in paragraph 10 (1) (e), (f) or

   (g)  or the alternate of that member.

(5) Questions arising at a meeting of the Commission shall be decided by the
affirmative votes of not fewer than 12 members.

(6) The Chairperson shall preside at all meetings of the Commission at which
he or she is present.

(7) If the Chairperson is not present at a meeting of the Commission -

   (a)  in a case where the member referred to in paragraph 10 (1) (e) is
present at the meeting - that member shall preside at the meeting; or

   (b)  in a case where the member referred to in paragraph 10 (1) (e) is not
present at the meeting - the members present at the meeting shall elect
one of their number to preside at the meeting.

(8) The Chairperson or member presiding has a deliberative vote.

(9) The Commission shall keep minutes of its proceedings.

(10) Subject to the preceding provisions of this section, the procedure at
meetings of the Commission shall be as determined by the Commission.

(11) The Commission may invite a person to attend a meeting of the Commission
for the purpose of advising or informing the Commission on any matter.

(12) A person referred to in sub-section (11) shall be paid such fees,
allowances and expenses (if any) as the Minister determines in respect of his
or her attendance at a meeting of the Commission.
