NATIONAL FOOD AUTHORITY ACT 1991 No. 118, 1991 - SECT 71
Applications continue in force
71. (1) If, in respect of an application for the development of a standard or
the variation of a standard:
(a) the National Health and Medical Research Council (in this section
called the "NHMRC") has not made a recommendation to the Council; or
(b) the NHMRC or any other body or authority has not rejected the
application; before the commencement of this Act, the application
continues in force, after that commencement, as if this Act had been
in force at the time the application was made and the application had
been made to the Authority under this Act as so in force.
(2) The Authority, having regard to what the NHMRC or any other authority or
body has done in relation to an application mentioned in subsection (1), may
omit to do any one or more of the matters that it is required to do under Part
3 in relation to that application.
(3) If the Authority decides, in respect of an application mentioned in
subsection (1), to prepare a draft standard or a draft variation of a
standard, the Authority must make a recommendation to the Council in respect
of that draft within 24 months after the day on which this Act commences.
