Establishment and constitution of Commission
PART II-THE NATIONAL CRIMES COMMISSION

Division 1-Establishment, Functions and Powers

6. (1) There is established by this Act a Commission by the name of the
National Crimes Commission.

(2) The Commission shall consist of a Chairman and not less than 1 nor more
than 4 other members.

(3) The Chairman and the other member or members shall be appointed by the
Governor-General.

(4) A member other than a member who is, and is expected to continue to be, a
Judge may be appointed as a full-time member or as a part-time member.

(5) A person shall not be appointed as Chairman unless-

   (a)  he is or has been a Judge; or

   (b)  he is enrolled as a legal practitioner, and has been so enrolled for
        not less than 5 years.

(6) A person shall not be appointed as a member unless he appears to the
Governor-General to be suitable for appointment by reason of his having
expertise, or having had experience, relevant to the work of the Commission.

(7) The performance of the functions or the exercise of the powers of the
Commission is not affected by reason only of a vacancy or vacancies in the
membership of the Commission.
