LIQUEFIED PETROLEUM GAS (GRANTS) AMENDMENT ACT 1985 No. 135 of 1985 - SECT 5
Termination of schemes, &c.
5. (1) The schemes in operation immediately before the commencement of this
Act shall be deemed to be revoked, or to have been revoked, as the case
requires, on that commencement.
(2) The Principal Act or a scheme shall not be taken to require, or to have
required at any time (whether before or after the commencement of this Act),
payments by a State to a person in respect of -
(a) liquefied petroleum gas sold by the person after the commencement of
this Act; or
(b) liquefied petroleum gas or naphtha delivered to the person after the
commencement of this Act.
(3) The Principal Act shall not be taken to require, or to have required at
any time (whether before or after the commencement of this Act), the payment
to a State, by way of financial assistance, of amounts equal to amounts
expended by the State in making payments to a person in respect of -
(a) liquefied petroleum gas sold by the person after the commencement of
this Act; or
(b) liquefied petroleum gas or naphtha delivered to the person after the
commencement of this Act.
(4) Without limiting the generality of the preceding sub-sections, those
sub-sections apply in relation to the operation of section 13 of the Principal
Act.
(5) In this section, "scheme" and "State" have the same respective meanings as
in the Principal Act.
