INDUSTRIAL RELATIONS ACT 1988 No. 86 of 1988 - SECT 27
Disclosure of interest by Commission members
27. (1) Where, for the purposes of a proceeding, the Commission is constituted
by, or includes, a member of the Commission who has or acquires any interest,
pecuniary or otherwise, that could conflict with the proper performance of the
member's functions in relation to the proceeding:
(a) the member shall disclose the interest to the parties to the
proceeding; and
(b) unless all the parties consent - the member shall not take part in the
proceeding or exercise any powers in relation to the proceeding.
(2) Where the President becomes aware that, for the purposes of a proceeding,
the Commission is constituted by, or includes, a member of the Commission who
has or acquires any interest, pecuniary or otherwise, that could conflict with
the proper performance of the member's functions in relation to the
proceeding:
(a) if the President considers that the member should not take part, or
should not continue to take part, in the proceeding - the President
shall give a direction to the member accordingly; or
(b) in any other case - the President shall cause the interest of the
member to be disclosed to the parties to the proceeding and the member
shall not take part in the proceeding or exercise any powers in
relation to the proceeding unless all the parties to the proceeding
consent.
