INTERNATIONAL CRIMINAL COURT ACT 2002 No. 41, 2002 - SECT 15
Attorney-General must take into account ICC's ability to refer matter to Assembly of States Parties or Security Council
In determining what action to take in relation to a request for cooperation,
the Attorney-General must take into account the power of the ICC to refer the
matter to the Assembly of States Parties or to the Security Council in
accordance with paragraph 7 of article 87 of the Statute if the ICC finds
that, contrary to the provisions of the Statute, Australia has failed to
comply with the request.
