HORTICULTURAL RESEARCH AND DEVELOPMENT CORPORATION ACT 1987 No. 166 of 1987 - SECT 45

45. (1) There shall be paid to the Corporation amounts equal to:

   (a)  amounts of levy received by the Commonwealth by virtue of section 9 of
        the Levy Act; and

   (b)  amounts received by the Commonwealth by way of penalty under section 8
        of the Levy Collection Act in relation to amounts of levy referred to
        in paragraph (a).

(2) There shall be paid to the Corporation amounts equal to:

   (a)  amounts of charge received by the Commonwealth by virtue of section 9
        of the Export Charge Act; and

   (b)  amounts received by the Commonwealth by way of penalty under section 8
        of the Export Charge Collection Act in relation to amounts of charge
        referred to in paragraph (a).

(3) Amounts payable under subsections (1) and (2) shall be paid out of the
Consolidated Revenue Fund, which is appropriated accordingly.

(4) The reference in paragraph (1) (a) to amounts of levy received by the
Commonwealth by virtue of section 9 of the Levy Act includes a reference to
amounts received by the Commonwealth by virtue of paragraph 7 (1) (a) of the
Levy Collection Act in relation to amounts of such levy, and the reference in
paragraph (2) (a) to amounts of charge received by the Commonwealth by virtue
of section 9 of the Export Charge Act includes a reference to amounts received
by the Commonwealth by virtue of paragraph 7 (1) (a) of the Export Charge
Collection Act in relation to amounts of such charge.

(5) The reference in paragraph (1) (b) to amounts received by the Commonwealth
by way of penalty under section 8 of the Levy Collection Act includes a
reference to amounts received by the Commonwealth by virtue of paragraph 7 (1)
(b) of that Act, and the reference in paragraph (2) (b) to amounts received by
the Commonwealth by way of penalty under section 8 of the Export Charge
Collection Act includes a reference to amounts received by the Commonwealth by
virtue of paragraph 7 (1) (b) of that Act.
