Health Legislation Amendment Act 1983 No. 54 of 1983 - SECT 24

24. Section 20 of the Principal Act is amended-

         (a)  by inserting in sub-section (1) ''by the Commission on behalf of
the Commonwealth'' after ''payable''; and

   (b)  by adding at the end thereof the following sub-section:

''(2) Where a person to whom a medicare benefit is payable under sub-section
(1) in respect of a professional service has not paid the medical expenses
that he has incurred in respect of that professional service, he shall not be
paid the medicare benefit but, if he so requests, there shall, in lieu of that
payment, be given to him personally, or sent to him by post at his last-known
address, a cheque for the amount of the medicare benefit drawn in favour of
the person by whom, or on whose behalf, the professional service was
rendered.''.
