FREEDOM OF INFORMATION AMENDMENT ACT 1991 No. 137 of 1991 - SECT 41

41. Section 59A of the Principal Act is amended:

   (a)  by omitting subsection (1) and substituting the following subsection:

"(1) Where, on a request having been made for access to a document containing
personal information about a person (including a deceased person), an agency
or Minister decides that the document to which the request relates, or an
edited copy of the document, is not an exempt document under section 41, the
person, or, if the person is deceased, the legal personal representative of
the person, may apply to the Tribunal for a review of the decision.";

   (b)  by omitting from paragraph (2) (a) "sections 55 and 61" and
        substituting "section 55";

   (c)  by omitting subsection (3) and substituting the following subsection:

"(3) Where:

   (a)  on a request having been made for access to a document containing
        personal information about a person (including a deceased person), an
        agency or Minister decides not to grant access to the document; and

   (b)  an application is made to the Tribunal for a review of the decision;
        the agency or Minister must, as soon as practicable, take all
        reasonable steps to inform the person, or, if the person is deceased,
        the legal personal representative of the person, of the application.".
