Family Law Amendment Act 1983 No. 72 of 1983 - SECT 51
Appeals from courts of summary jurisdiction
51. (1) Section 96 of the Principal Act is amended by omitting sub-section (2)
and substituting the following sub-section:
''(2) The Supreme Court of each State is invested with federal jurisdiction,
and jurisdiction is conferred on the Supreme Court of each Territory, with
respect to matters arising under this Act in respect of which appeals are
instituted under this section.''.
(2) Notwithstanding the amendment made by paragraph 18 (1) (a) of the
Family Law Amendment Act 1979, an appeal does not lie from a court of summary
jurisdiction of a State or Territory exercising jurisdiction under the Family
Law Act 1975 to a Supreme Court of a State or Territory in respect of which a
Proclamation under sub-section 96 (3) of the Family Law Act 1975 had been made
before the day on which the Family Law Amendment Act 1979 received the Royal
Assent.
