ENDANGERED SPECIES PROTECTION ACT 1992 No. 194 of 1992 - SECT 8

8. A species is presumed extinct at a particular time if:

   (a)  it has not been definitely located in nature during the preceding 50
        years; or

   (b)  it has not been definitely located in nature during the preceding 10
        years despite thorough searching during that period.
