EMPLOYMENT SERVICES ACT 1994 No. 176 of 1994 - SECT 25

When a person becomes a participant in the case management system
Determinations about participants-general
25.(1) The Minister may make a written determination that a person included in
a specified class of persons becomes a participant in the case management
system at a specified time if, at that time:

   (a)  persons included in that class are registered with the CES; or

   (b)  unemployment benefits (within the meaning of paragraph 51(xxiiiA) of
        the Constitution) are being provided by the Commonwealth to or in
        respect of persons included in that class. A determination has effect
        accordingly.

Determinations about participants-special

(2) If the Employment Secretary is satisfied that there are special
circumstances, the Employment Secretary may make a written determination that
a specified person becomes a participant in the case management system at a
specified time if, at that time:

   (a)  the person is registered with the CES; or

   (b)  unemployment benefits (within the meaning of paragraph 51(xxiiiA) of
        the Constitution) are being provided by the Commonwealth to or in
        respect of the person. A determination has effect accordingly.

Registration with the CES

(3) For the purposes of this section, a person is registered with the CES if,
and only if, the person is registered by the CES as being unemployed.

Disallowable instrument

(4) A determination under subsection (1) is a disallowable instrument for the
purposes of section 46A of the Acts Interpretation Act 1901.

Delegation

(5) The Employment Secretary may, by writing, delegate all or any of his or
her powers under subsection (2) to an officer of the Department.
