PART IV-MISCELLANEOUS
38. Where the Board is satisfied that-

   (a)  an act or thing (including the making of an agreement, arrangement or
        payment, the forming of a corporation or the allocation of income or
        expenditure as between different corporations or different years) has
        been done with a view to the obtaining of, or to affecting the amount
        of, a grant to a person; and

   (b)  the act or thing is of such a nature that it constitutes an attempt to
        abuse this Act, the Board may, for the purposes of this Act, disregard
        any expenditure incurred in relation to the doing of that act or thing
        or make such adjustment to the amount of the eligible expenditure or
        the export earnings of the person as it thinks necessary to prevent
        the abuse.
