EMPLOYMENT, EDUCATION AND TRAINING AMENDMENT ACT 1991 No. 47 of 1991 - SECT 3

3. Section 33 of the Principal Act is amended by omitting subsections (1) and
(2) and substituting the following subsections:

"(1) Subject to subsection (2), the Minister may appoint a person to act as a
member of a Council:

   (a)  during a vacancy in the office of that member, whether or not an
        appointment has previously been made to that office; or

   (b)  during any period, or during all periods, when that member is absent
        from duty or from Australia or is, for any other reason (including the
        reason that the member is acting as the Chairperson), unable to
        perform the duties of the office of member; but a person appointed to
        act during a vacancy is not to continue in that office for more than
        12 months.

"(2) A member of the Board, or a person appointed under subsection 21 (3), may
only be appointed to act as a member of a Council where:

   (a)  a vacancy in the membership of the Council results in there being less
        than 2 members of the Board on the Council; or

   (b)  the member of the Council who is absent or unable to perform the
        duties of the office is a member of the Board.".
