DEFENCE LEGISLATION AMENDMENT ACT (No. 2) 1988 No. 104 of 1988 - SECT 9

9. (1) Section 9C of the Principal Act is amended:

   (a)  by inserting in subsection (1) ", Vice Chief of the Defence Force"
after "Chief of the Defence Force";

   (b)  by omitting subsections (2) to (6) and substituting the following
        subsection:

"(2) Anything done by or in relation to an officer purporting to act under an
appointment under subsection (1) is not invalid merely because:

   (a)  the occasion for the appointment had not arisen;

   (b)  there was a defect or irregularity in connection with the appointment;

   (c)  the appointment had ceased to have effect; or

   (d)  the occasion for the person to act had not arisen or had ceased.".

(2) Notwithstanding the amendments of section 9C of the Principal Act made by
this section, that section as in force immediately before it was so amended
continues to apply to any appointment of a person to act that was in force
immediately before the commencement of this section as if that section had not
been amended.
