COMMUNITY SERVICES AND HEALTH LEGISLATION AMENDMENT ACT (No. 2) 1990 No. 141 of 1990 - SECT 29

29. Section 23DM of the Principal Act is amended:

   (a)  by omitting from paragraphs (4) (a) and (c) all words from and
including "give" and substituting "by notice in writing, refer the matter to
the Medical Services Committee of Inquiry for the State in which the pathology
services were initiated or, if there is more than one such Committee in that
State, to one of those Committees";

   (b)  by inserting after subsection (4) the following subsection:

"(4A) Where the Minister refers a matter to a Medical Services Committee of
Inquiry under subsection (4), the Minister shall include in the notice to the
Committee particulars of the grounds referred to in subsection (1).".
