COMMUNITY SERVICES AND HEALTH LEGISLATION AMENDMENT ACT 1990 No. 106 of 1990 - SECT 9

9. Section 20 of the Principal Act is amended:

   (a)  by omitting from subsection (2) "and to give security for the carrying
        out of the agreement";

   (b)  by omitting subsections (3) and (4) and substituting the following
        subsection: "(3) An agreement may include provision for:

   (a)  the repayment of the whole or a part of a grant; and

   (b)  the giving of security for:

   (i)  the repayment of the whole or a part of a grant; or

   (ii) the payment to the Commonwealth of the amount that under the terms and
        conditions is taken to represent the Commonwealth's interest in:

                (A)  land purchased (with or without buildings); and

                (B)  buildings constructed or altered; and

                (C)  equipment acquired, altered, added to or installed; as a
                     result of the application of a grant or a grant and other
                     money (whether or not that amount is more than the amount
                     of the grant); and

   (c)  the use and disposal of, and the recovery of, the amount that under
        the terms and conditions is taken to represent the Commonwealth's
        interest in:

   (i)  land purchased (with or without buildings); and

   (ii) buildings constructed or altered; and

   (iii) equipment acquired, altered, added to or installed; as a result of
        the application of a grant or a grant and other money (whether or not
        that amount is more than the amount of the grant).".
