CHILDCARE REBATE ACT 1993 No. 112 of 1993 - SECT 16
Other people may be treated as Australian residents
16.(1) A person who is not an Australian resident within the meaning of
section 14 is taken to be an Australian resident if the Commission so
determines in writing.
(2) The Commission may so determine if it is satisfied that:
(a) hardship would be caused to the applicant if the applicant were not
treated as an Australian resident; or
(b) because of the special circumstances of the particular case, the
applicant should be treated as an Australian resident.
(3) A person may apply in writing to the Commission for such a determination.
Note: Refusals to make determinations are reviewable under Division 3 of Part
5.
