CHILDCARE REBATE ACT 1993 No. 112 of 1993 - SECT 15

15.(1) A person who is not an Australian resident within the meaning of
section 14 is taken to be an Australian resident if the person:

   (a)  is undertaking a course of study at an educational institution in
        Australia; and

   (b)  is receiving from the Commonwealth for the purpose of undertaking that
        course of study, financial assistance of a kind specified in a
        determination under subsection (2).

(2) The Minister may make determinations as to the kinds of financial
assistance to which paragraph (1)(b) applies.

(3) Determinations under subsection (2) are disallowable instruments for the
purposes of section 46A of the Acts Interpretation Act 1901.
