CHILDCARE REBATE ACT 1993 No. 112 of 1993 - SECT 11

Definition of dependent child
11.(1) Subject to subsection (2), a child is a dependent child of another
person if:

   (a)  the other person has the right (whether alone or jointly with a third
        person):

        (i)    to have the daily care and control of the child; and

        (ii)   to make decisions about the daily care and control of the
               child; and the child is in the other person's care and control;
               or

   (b)  the child:

        (i)    is not a dependent child of someone else under paragraph (a);
               and

        (ii)   is wholly or substantially in the other person's care and
               control.

(2) A child cannot be a dependent child if he or she has turned 13.
