COMMONWEALTH FUNCTIONS (STATUTES REVIEW) ACT 1981 No. 74 of 1981 - SECT 189

Power of Minister to enter into agreement
189. (1) The Minister may, on behalf of the Commonwealth, enter into an
agreement with a body corporate that proposes to carry on, or carries on, a
business of insurance of the kind carried on by the Corporation for the sale
to that body corporate, with effect on and from the commencement of a day
specified in, or ascertained in accordance with, the agreement, of the whole
or a part of the business of insurance carried on by the Corporation.

(2) Notwithstanding section 43 of the Principal Act, a person referred to in
that section shall, if so required by the Minister or an officer of the
Department of Housing and Construction, make available such information
relating to the operations or affairs of the Corporation as the Minister or
officer considers necessary for the purpose of negotiating the sale of the
business or a part of the business of the Corporation, but nothing in this
sub-section permits the disclosure to the Minister or an officer of
information relating to the affairs of a particular person other than the
Corporation.

(3) If the Minister enters into an agreement in accordance with sub-section
(1), the Minister shall determine whether the sale for which the agreement
provides is to be effected in accordance with section 190 or 191.
