COMPLAINTS (AUSTRALIAN FEDERAL POLICE) ACT 1981 No. 21 of 1981 - SECT 48

48. (1) Where an investigation is conducted under this Part, the person
holding the investigation shall report the results of the investigation -

   (a)  subject to paragraph (b) - to the Commissioner; or

   (b)  if the Commissioner had agreed to the investigation being conducted in
        accordance with the directions given by the Ombudsman - to the
        Ombudsman, and may include in his report such recommendations (if any)
        arising out of the investigation as he deems fit.

(2) Where the person holding the investigation reports to the Commissioner,
the Commissioner shall -

   (a)  as soon as practicable after the report is furnished to him, cause a
        copy of the report to be furnished to the Ombudsman, together with any
        comments relating to the report that he wishes to make; and

   (b)  cause to be furnished to the member concerned and, unless the identity
        of the complainant is not known, to the complainant, in such manner
        and at such times as he thinks fit, particulars of the results of the
        investigation, together with any comments he wishes to make concerning
        the investigation.

(3) Where the person holding the investigation reports to the Ombudsman, the
Ombudsman shall -

   (a)  as soon as practicable after the report is furnished to him, furnish a
        copy of the report to the Commissioner, together with any comments
        relating to the report that he wishes to make; and

   (b)  unless the identity of the complainant is not known, furnish
        particulars of the results of the investigation to the complainant in
        such manner and at such time as he thinks fit, together with any
        comments he wishes to make concerning the investigation.

(4) Where the Commissioner receives a copy of the report from the Ombudsman
under sub-section (3), the Commissioner shall furnish particulars of the
results of the investigation to the member concerned in such manner and at
such time as he thinks fit, together with any comments he wishes to make
concerning the investigation.
