COMPLAINTS (AUSTRALIAN FEDERAL POLICE) ACT 1981 No. 21 of 1981 - SECT 40
Delegation
40. (1) The Ombudsman may, by instrument in writing, delegate to a Deputy
Ombudsman, to a member of the staff appointed or employed for the purposes of
the Ombudsman Act 1976 under the Public Service Act 1922 or, with the consent
of the Minister, to any other person any of his powers under this Act, except
this power of delegation or the power conferred by section 31, 32 or 33.
(2) A power so delegated when exercised by the delegate shall, for the
purposes of this Act, be deemed to have been exercised by the Ombudsman.
(3) A delegate shall, upon request by a person affected by the exercise of any
powers delegated to him, produce the instrument of delegation, or a copy of
the instrument, for inspection.
(4) A delegation under this section does not prevent the exercise of a power
by the Ombudsman.
