COMPLAINTS (AUSTRALIAN FEDERAL POLICE) ACT 1981 No. 21 of 1981 - SECT 28
Reference of question to the Administrative Appeals Tribunal
28. (1) Where a complaint concerning the taking of action in pursuance of a
discretionary power conferred by an enactment is being investigated by the
Ombudsman or by the Investigation Division, the Ombudsman may recommend to the
Commissioner that a specified question relating to the taking of that action
or to the exercise of the power be referred to the Administrative Appeals
Tribunal for an advisory opinion.
(2) Where the Ombudsman makes a recommendation to the Commissioner in
accordance with sub-section (1), the Commissioner shall refer the question
specified in the recommendation to the Administrative Appeals Tribunal, and
that Tribunal may then give an advisory opinion on the question.
