CAPTAINS FLAT (ABATEMENT OF POLLUTION) AGREEMENT ACT 1975 No. 121 of 1975 - SCHEDULE


SCHEDULE
Section 3

  AN AGREEMENT made the         day of             One thousand nine hundred
and seventy-five between-

THE GOVERNMENT OF THE COMMONWEALTH (in this agreement called ''Australia'') of
the one part; and

THE GOVERNMENT OF THE STATE OF NEW SOUTH WALES (in this agreement called ''New
South Wales'') of the other part.

WHEREAS-

                (A)  Australia and New South Wales mutually recognize that it
                     is desirable in the public interest that pollution of the
                     Molonglo River emanating from the mine and mine waste
                     dumps at Captains Flat should be abated in order to
                     protect the river and Lake Burley Griffin;

                (B)  the two Governments accordingly have decided that the
                     works, both capital and maintenance, that are necessary
                     for that purpose will be established and carried out by
                     their respective authorities and propose that the costs
                     of carrying out the works shall be financed as provided
                     in this agreement;

                (C)  the Australian Parliament has authorized the execution of
                     this agreement on behalf of Australia and the provision
                     of financial assistance in accordance with its
                     provisions:

NOW IT IS HEREBY AGREED as follows:

PART I-INTERPRETATION

1. In this agreement unless inconsistent with the subject matter or a contrary
intention appears-

''appropriate Minister'', in relation to the State, means the Minister having
for the time being the administration for New South Wales of the matters to
which this agreement relates and, if those matters are at any time
administered by more than one Minister, means the Minister or each of the
Ministers having for the time being the administration for New South Wales of
the matters to which the relevant provision of this agreement relates or to
which this agreement relates, according to the requirements of the context;

''approved body'' means a body approved by the Minister for the purposes of
this agreement, being-

        (i)    an authority of the State; or

        (ii)   a local governing body of the State;

''approved program'' means a program approved as provided by clauses 5 and 6;

''the Minister'' means the Minister for Urban and Regional Development or such
other Minister of Australia as is for the time being administering the Act by
which the execution of this agreement is approved by the Australian
Parliament;

''the State'' means the State of New South Wales; and

''the Treasurer'' means the Treasurer of Australia.

2. In this agreement, unless the context otherwise requires-

   (a)  a reference to a Minister includes such other Minister of Australia or
        of New South Wales, as the case may be, who is for the time being
        acting for the Minister referred to;

   (b)  a reference to a clause refers to the relevant clause of this
        agreement and a reference to a sub-clause refers to the relevant
        sub-clause of the clause in which the reference appears; and

   (c)  words in the singular include the plural and words in the plural
        include the singular.

PART II-OPERATION OF AGREEMENT

3. This agreement shall be deemed to have commenced to operate on the 1st July
1974 and acts or things consistent with its provisions that have been done by
or on behalf of a party since that date in anticipation of it so coming into
force shall be regarded as having been done under and in accordance with its
provisions.

4. This agreement shall not affect or in any way derogate from the rights and
obligations in relation to the Queanbeyan and Molonglo Rivers of either party
under or by virtue of the provisions of the Agreement which was made the 18th
day of October 1909 and which was approved by the Seat of Government 
Acceptance Act 1909 and the Seat of Government Surrender Act, 1909 of their
respective Parliaments.

PART III-PROGRAMS

5. (1) The programs to which this agreement applies shall be programs that the
Minister, in consultation with the appropriate Minister for New South Wales,
approves for the purposes of this agreement, being programs of, or relating
to, capital or maintenance works to be carried out either by New South Wales
or by an approved body for abating pollution from mine wastes in the area of
Captains Flat.

(2) The approval of a program by the Minister referred in sub-clause (1) may
have been given prior to the coming into force of this agreement.

6. An approved program shall be varied in accordance with such variations as
the Minister, in consultation with the appropriate Minister of New South
Wales, may approve and references to this agreement to an approved program
shall be references to the relevant program as so varied.

7. Where the Minister, with the agreement of the appropriate Minister of New
South Wales, has attached conditions to the approval of a program or of a
variation of an approved program, the conditions shall be applicable to the
approved program for the purposes of the operation of this agreement.

8. Arrangements for or in connection with the carrying out of an approved
program shall be as from time to time agreed between Australia and New South
Wales.

9. Australia and New South Wales acknowledge and agree that each approved
program will be carried out as approved by the Minister, upon and subject to
any conditions applicable under clause 7 and in accordance with any
arrangements referred to in clause 8 and undertake to do all acts and things
necessary to ensure that their respective obligations in these respects are
carried out.

10. New South Wales shall use its best endeavours to ensure that land,
buildings and other improvements to be used for purposes nominated in an
approved program shall, unless and until otherwise agreed between the parties,
be used for those purposes and only for those purposes.

11. The appropriate Minister of New South Wales shall from time to time at the
request of the Minister furnish to the Minister such information relating to
an approved program as is reasonably required by the Minister in connection
with that approved program.

PART IV-FINANCIAL ASSISTANCE

12. (1) Australia will, subject to and in accordance with the provisions of
this agreement, provide financial assistance to New South Wales (hereafter in
this agreement referred to as ''financial assistance'') in respect of
expenditure by New South Wales or by an approved body in accordance with
approved programs.

(2) The financial assistance shall, except as provided in clause 13, be
equivalent to the expenditure in respect of the approved programs but, in
respect of capital works, shall not exceed in total the amount of Two million
five hundred thousand dollars ($2,500,000).

13. (1) Financial assistance in respect of expenditure on capital works shall
be-

   (a)  as to four fifths of the financial assistance-by way of non-repayable,
        non-interest bearing grant; and

   (b)  as to one fifth of the financial assistance-by way of interest
        bearing, repayable loan.

(2) Financial assistance in respect of expenditure on maintenance works shall
be by way of non-repayable, non-interest bearing grant and shall be limited to
an amount which is equal to one half of the expenditure to which the financial
assistance relates but which does not exceed at any time the amount that has
been contributed by New South Wales towards meeting that expenditure.

14. Financial assistance in respect of expenditure by an approved body shall,
unless otherwise agreed between Australia and New South Wales, be made
available by New South Wales to that approved body on conditions that are
equivalent to the conditions that are applicable to the provision of the
financial assistance in accordance with this agreement.

PART V-PAYMENTS AND ADVANCES

15. Subject to the provisions of this agreement, payments of financial
assistance will be made by Australia to New South Wales from time to time at
the request of New South Wales.

16. New South Wales shall not be entitled to a payment of financial assistance
in respect of any expenditure unless New South Wales has furnished to the
Treasurer-

   (a)  a statement of that expenditure in accordance with a form approved by
        the Treasurer accompanied by a certificate of the Auditor-General of
        the State certifying, to the extent practicable, inter alia, that in
        his opinion the amounts shown in the statement as having been expended
        were expended in accordance with the relevant approved program; and

   (b)  such further information, if any, in respect of that expenditure as
        the Treasurer may reasonably require.

17. (1) The Treasurer may, at such times and in such amounts as he thinks fit,
make advances on account of payments of financial assistance that may become
payable in accordance with this agreement.

(2) An amount or part of an amount advanced to New South Wales under this
clause may be deducted from a payment of financial assistance that
subsequently becomes payable.

(3) If in respect of an approved program the total amount of the payments
under clause 15 and the advances under this clause made to New South Wales
exceeds the total amount of financial assistance payable in accordance with
this agreement in respect of that approved program the amount of the excess
shall be repaid by New South Wales to Australia at the request of the
Treasurer.

(4) New South Wales shall ensure that an amount, or any part of any amount,
advanced to New South Wales under this clause and not repaid under sub-clause
(3) is not used or applied except for the purpose of meeting or reimbursing,
as the case may be, the expenditure to which the advance relates.

PART VI-PAYMENTS BY STATE

18. (1) New South Wales shall pay interest in respect of the financial
assistance by way of loan referred to in paragraph (1) (b) of clause 13 at the
long-term bond rate provided for by sub-clause (3).

(2) The interest payable by New South Wales shall accrue from the date on
which an advance or payment is made on so much of the advance or payment as
has not been repaid in accordance with clause 19 or, in the case of an
advance, refunded under sub-clause (3) of clause 17.

(3) For the purposes of sub-clause (1), the long term bond rate, in relation
to any interest, is the rate that is equivalent to the rate of yield to
maturity of the long-term loan of the last loan-raising by the Australian
Government in Australia for public subscription before the date on which the
advance or payment in respect of which the interest is payable was made.

(4) The amount of the interest that has accrued in accordance with this clause
in respect of an advance or payment shall be calculated as at, and shall be
payable by New South Wales on, each fifteenth day of January and July up to
and including the fifteenth day of January or of July that immediately
precedes the date on which repayments commence in respect of the advance or
payment in accordance with clause 19.

(5) Interest that accrues in accordance with this clause after the fifteenth
day of January or of July that immediately precedes the day on which
repayments commence in respect of an advance or payment in accordance with
clause 19 shall be payable by New South Wales as provided in that clause.

19. (1) Subject to the provisions of this clause, each of the payments of
financial assistance referred to in paragraph (1) (b) of clause 13 and all of
the advances of that financial assistance that are not refunded under
sub-clause (3) of clause 17, together with the interest thereon referred to in
sub-clause (5) of clause 18, shall be repayable by New South Wales by 40 equal
consecutive half-yearly instalments, the first instalment to be made on the
fifteenth day of January or the fifteenth day of July that next occurs after
the expiration of two years from the date on which the payment or advance was
made to New South Wales and subsequent instalments to be made on each
succeeding fifteenth day of July and fifteenth day of January.

(2) In addition to paying half-yearly instalments in accordance with
sub-clause (1) New South Wales may on the fifteenth day of January or the
fifteenth day of July in any year, after having given the Treasurer notice in
writing of at least one month of its intention to do so, pay to Australia an
amount of 100,000 dollars or a multiple thereof.

(3) Interest shall accrue on an amount paid by New South Wales under
sub-clause (2) at the rate that is applicable in accordance with clause 18 to
the payment or advance of financial assistance with respect to which the
amount is paid by New South Wales, the interest to be calculated from the date
of payment and compounded with half-yearly rests on each fifteenth day of
January and of July.

(4) When on any fifteenth day of January or of July the payment due by New
South Wales under sub-clause (1) exceeds the amount by which the unrepaid
balance of the relevant payment or advance, together with unpaid interest on
the payment or advance up to and including that date, exceeds the total of the
amounts paid by New South Wales to Australia in accordance with sub-clause (2)
with respect to that payment or advance, together with interest accrued on
those amounts up to and including that date under sub-clause (3), New South
Wales shall pay to Australia the amount of the second mentioned excess in lieu
of the amount of the payment due under sub-clause (1) and no further payment
shall be required to be made by New South Wales to Australia under this clause
in respect of that payment or advance.

PART VII-GENERAL

20. (1) The accounts, books, vouchers, documents and other records relating to
the carrying out of approved programs shall be subject to audit.

(2) A report by the Auditor-General of the State on the audit and on the
financial statements shall be furnished by New South Wales to the Treasurer
for every year in respect of each approved program. Each report shall, inter
alia, indicate to the extent practicable whether in the opinion of the
Auditor-General-

   (a)  the financial statements are based on proper accounts and records and
        are in agreement with those accounts and records; and

   (b)  the receipt and expenditure of moneys are in accordance with this
        agreement; and shall include reference to such other matters arising
        out of the audit and financial statements as the Auditor-General
        considers should be reported to the Treasurer.
