COMMONWEALTH EMPLOYEES' REHABILITATION AND COMPENSATION ACT 1988 No. 75 of 1988 - SECT 99
Delegation by Commission
99. (1) The Commission may, by resolution, delegate to an officer of, or a
person employed by, the Commonwealth or a Commonwealth authority all or any of
the Commission's powers and functions.
(2) A delegation under this section:
(a) continues in force in spite of a change in the membership of the
Commission; and
(b) may be varied or revoked by resolution of the Commission (whether or
not constituted by the persons constituting the Commission at the time
when the power or function was delegated).
(3) A certificate signed by the Chief Executive officer stating any matter
with respect to a delegation of a power or function under this section is
prima facie evidence of that matter.
(4) A document purporting to be a certificate under subsection (3) shall,
unless the contrary is established, be deemed to be such a certificate and to
have been duly given.
