CUSTOMS AND EXCISE LEGISLATION AMENDMENT ACT (No. 2) 1989 No. 24 of 1989 - SECT 39

39. Section 78A of the Principal Act is amended:
(a) by omitting from subsection (4) "because only that" and substituting

"only because";

   (b)  by inserting after subsection (4) the following subsection:

"(4AA) Rebate is not payable to a person in respect of diesel fuel unless the
application for the rebate:

   (a)  is made in accordance with an approved form;

   (b)  includes such information as is required by the form;

   (c)  is signed and witnessed in the manner indicated in the form; and

   (d)  is given to an officer.";

   (c)  by omitting paragraphs (4A) (a), (b) and (c).
