CUSTOMS AND EXCISE LEGISLATION AMENDMENT ACT 1990 No. 111 of 1990 - SECT 9

9. Section 39 of the Principal Act is amended:
(a) by inserting in subsection (1) "under section 36 or 37" after "has been
made";
(b) by inserting in subsection (1B) "under section 36 or 37" after "entry of
goods";

   (c)  by omitting subsection (2) and substituting the following subsection:

"(2) Authority under this section to deal with goods may be expressed to be
subject to the condition:

   (a)  that any specified permission for the goods to be dealt with, (however
        it is described) that may be required under another law of the
        Commonwealth is obtained; and

   (b)  that any specified obligation under this Act in respect of the goods
        is complied with; and, for the purposes of this Act, where authority
        under this section is expressed to be subject to such a condition, it
        is taken not to have been given until any permission referred to in
        the condition has been obtained and any obligation referred to in that
        condition has been complied with.".
