CORPORATIONS ACT 1989 No. 109 of 1989 - SECT 1328
Court may resolve transitional difficulties
1328. (1) Where any difficulty:
(a) arises in applying a provision of this Act in relation to a particular
case in relation to which, if this Act had not been enacted, a law
corresponding to that provision would have applied; or
(b) arises, because of a provision of this Act, in applying, in relation
to a particular case, another such provision or a law corresponding to
another such provision; the Court may, on the application of an
interested person, make such order as it thinks proper to remove the
difficulty.
(2) An order under this section has effect despite anything in a provision of
this Act or in a law corresponding to such a provision.
(3) This section has effect subject to the Constitution. (The next section is
