BROADCASTING AND TELEVISION AMENDMENT ACT 1985 No. 66 of 1985 - SECT 29

29. Section 81 of the Principal Act is amended-

   (a)  by omitting from sub-section (2) "and television stations in the area
        served or to be served in pursuance" and substituting "services
        provided pursuant to other licences having service areas that overlap
        the service area";

   (b)  by omitting from sub-section (3) "licence for a commercial
        broadcasting station or for a commercial television station" and
        substituting "commercial licence";

   (c)  by omitting from sub-section (4) "broadcasting licence or public
        television"; and

   (d)  by omitting sub-section (5) and substituting the following
        sub-sections:



"(4A) A remote licence shall not be granted except to-

   (a)  a company formed within the limits of the Commonwealth or a Territory
        and having a share capital; or

   (b)  a consortium of companies to which paragraph (a) applies.



"(5) Such fees as are prescribed are payable in respect of-

   (a)  grants and renewals of public licences and re-broadcasting licences;
        and

   (b)  grants, renewals and transfers of re-transmission licences."; and
(e) by inserting in sub-section (6) "a remote licence or" after "Where".
