ANTARCTIC TREATY (ENVIRONMENT PROTECTION) ACT 1980 No. 103 of 1980 - SECT 18
Seizure
18. (1) An inspector may seize any article that he reasonably believes to have
been involved in the commission of an offence against this Act and may retain
it until the expiration of a period of 60 days after the seizure or, if
proceedings for an offence against this Act in the commission of which it may
have been involved are commenced within that period, until the proceedings
(including any appeal) are completed.
(2) An inspector may seize any animal, plant, virus, bacterium, yeast or
fungus that he reasonably believes to have been involved in the commission of
an offence against this Act.
(3) Where anything has been seized under sub-section (2), the Minister may
cause it to be retained or disposed of and, if it was not involved in the
commission of an offence against this Act, any person who has suffered loss or
damage by reason of the seizure is entitled to reasonable compensation.
