AUSTRALIAN OVERSEAS PROJECTS CORPORATION ACT 1978 No. 105 of 1978 - SECT 9

9. (1) The Corporation shall not agree to carry out the whole, or a part, of
an overseas development project in accordance with paragraph 6 (1) (d) unless-

   (a)  an Australian private organization that is able and willing to carry
        out, on behalf of the Corporation, some or all of the work to be
        carried out in relation to the project requests it to do so; and

   (b)  the Minister approves its doing so.

(2) The Minister shall not give an approval for the purposes of sub-section
(1) with respect to an overseas development project unless he is satisfied
that there is no Australian private organization able and willing to carry out
the project, or the part of the project, concerned.
