AUSTRALIAN NATIONAL RAILWAYS COMMISSION ACT 1983 No. 140 of 1983 - SECT 15
Power to enter land, &c.
15. (1) The Commission may -
(a) for the purpose of ascertaining the suitability of any land (including
land owned or occupied by the Commonwealth or a State or Territory)
for the purposes of the Commission -
(i) enter on, and inspect, the land; and
(ii) on land so entered, do any act or thing necessary or convenient
for that purpose, including, without limiting the generality of
the foregoing, making surveys, taking levels, sinking bores,
taking samples, digging pits and examining the soil; and
(b) for the purpose of surveying or obtaining information in relation to
any land that, in the opinion of the Commission, is or may be suitable
for the purposes of the Commission -
(i) enter on adjacent land (including land owned or occupied by
the Commonwealth or a State or Territory); and
(ii) on land so entered, do any act or thing necessary or convenient
for that purpose, including, without limiting the generality of
the foregoing, making surveys and taking levels.
(2) The Commission shall, before exercising its powers under sub-section (1)
in relation to any land, give reasonable notice, in writing, of its intention
to do so to -
(a) the owner of the land; and
(b) if the land is occupied by a person other than the owner of the land -
the occupier of the land.
(3) A notice under sub-section (2) in relation to land shall specify the
purpose for which the Commission intends to exercise its powers under
sub-section (1) in relation to the land.
